Overview

This website is operated by Martin Consuegra Martinez, trading as Lorvyk Atlas ("we", "us", "our"), 54633980-X, Calle Santa Ana 17 Esc 4 1H Murcia 30012, Spain.

By visiting lorvyk.com or placing an order, you agree to these Terms of Service, together with our Privacy Policy, Refund & Return Policy, Shipping Policy and Cookie Policy, all of which are incorporated here by reference. If you do not agree with these terms, please do not use the Site.

We may update these terms at any time by posting a new version on this page. Continued use of the Site after changes are posted means you accept them. The version in force is the one published when you place your order.

1. Eligibility

By placing an order you confirm that you are at least 18 years old, or that you have the consent of a parent or legal guardian, and that the information you give us is accurate and complete.

You may not use our products or the Site for any unlawful purpose, to violate any law in your jurisdiction, to infringe anyone's intellectual property, to transmit malware, to harvest data, or to interfere with the security or operation of the Site. We may terminate your access for breach of these terms.

2. Products, images and colour

  • All items are printed to order. Nothing is held in stock.
  • We work hard to display our art accurately, but we cannot guarantee that your monitor or phone shows colours exactly as they print. Screens emit light and are individually calibrated; art paper and canvas reflect it. Deep blues and metallic tones in particular look different in print. Reasonable variation between the on-screen image and the delivered piece is inherent to printing and is not a defect.
  • Product mock-ups show the art framed or styled in a room for illustration only. Frames, mats, furniture and props are not included unless the product page explicitly says so.
  • Sizes are listed in inches and are approximate, with a manufacturing tolerance of up to 1/8 inch.
  • Paper texture, canvas weave and slight trim variation between print runs are characteristics of the medium.

We reserve the right to limit sales, to discontinue any product at any time, and to modify product descriptions and specifications without notice.

3. Pricing and payment

  • All prices are in U.S. dollars (USD) and include shipping to U.S. addresses.
  • Applicable sales tax is calculated and shown at checkout where we are required to collect it.
  • We reserve the right to change prices at any time. The price that applies to your order is the one displayed when you complete checkout.
  • Pricing errors: if a product is listed at an obviously incorrect price due to a typographical or system error, we may cancel the order, even after confirmation, and will refund you in full. We will always contact you first.
  • Payment is taken at checkout through the providers shown there. By submitting payment details you confirm you are authorised to use that payment method.

4. Order acceptance

Your order is an offer to buy. Our order-confirmation email acknowledges receipt; the contract is formed when we send your shipping confirmation.

We may refuse or cancel any order, in whole or in part, including where: the item is unavailable, we detect suspected fraud or an unauthorised transaction, the order appears to be for resale, the shipping address is invalid, or a pricing error occurred. If we cancel after payment, we refund you in full.

5. Intellectual property

All artwork, designs, illustrations, text, photographs, layout, logos and brand names on this Site are owned by Lorvyk Atlas or used under licence, and are protected by copyright and trademark law.

When you buy a print, you buy the physical object and a licence to display it privately in your own home or workspace. You do not acquire the copyright or any commercial rights.

Without our prior written permission you may not:

  • reproduce, scan, photograph for resale, or digitally copy the artwork
  • print the design on other products, or make derivative works from it
  • resell, license or distribute the artwork, whether physically or as digital files
  • use the artwork commercially, including in advertising, packaging, NFTs, or AI training datasets

You may photograph your print in your own home and share it on social media — we would love that, and a tag is always welcome.

Copyright complaints

If you believe material on this Site infringes your copyright, send a notice to hello@lorvyk.com including: identification of the work, identification of the material and its location on the Site, your contact details, a statement of good-faith belief that the use is unauthorised, a statement under penalty of perjury that your notice is accurate and that you are authorised to act, and your signature. We remove infringing material promptly and terminate repeat infringers.

6. User content and feedback

If you post reviews, comments, photographs or other content to the Site or send them to us, you grant us a non-exclusive, royalty-free, worldwide licence to use, reproduce and display that content in connection with our business, including in marketing, with attribution to your first name or handle where you provided it.

You are responsible for what you submit. Do not submit anything unlawful, defamatory, obscene, infringing, or containing anyone's private information. We may remove any user content at our discretion and are under no obligation to publish or keep it.

7. Accuracy of information

We do our best to keep the Site accurate and up to date, but content may occasionally contain errors, inaccuracies or omissions relating to product descriptions, pricing, promotions, offers or availability. We reserve the right to correct these and to update information at any time without prior notice. Historical information on the Site is provided for reference only.

Astrological and zodiac content on this Site is provided for entertainment and decorative purposes. It is not advice of any kind — medical, psychological, financial or legal — and should not be relied on as such.

8. Third-party services

Payment processing, printing, fulfilment, shipping, email and analytics are provided by third parties. Their tools and links may appear on the Site. We are not responsible for the content, accuracy or practices of third parties, and any transaction you enter into with them directly is between you and them. Please read their terms before using their services.

9. Disclaimer of warranties

Except where excluded by law, the Site and its content are provided "as is" and "as available", without warranties of any kind, express or implied, including implied warranties of merchantability, fitness for a particular purpose and non-infringement. We do not warrant that the Site will be uninterrupted, timely, secure or error-free, or that any content is accurate or reliable.

This section does not exclude or limit any warranty or right that cannot be excluded or limited under applicable consumer law. Your statutory rights regarding faulty or misdescribed goods remain fully intact.

10. Limitation of liability

To the maximum extent permitted by law,  Martin Consuegra Martinez, its officers, employees and suppliers are not liable for any indirect, incidental, special, consequential or punitive damages, or for lost profits, lost data or loss of goodwill, arising from your use of the Site or any product bought through it.

Where liability cannot be excluded, our total liability for any claim is limited to the amount you paid for the order giving rise to the claim.

Nothing in these terms excludes or limits our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for any other liability that cannot lawfully be excluded.

11. Indemnification

You agree to indemnify and hold harmless Martin Consuegra Martinez and its suppliers from any claim or demand, including reasonable legal fees, arising from your breach of these terms or your violation of any law or third-party right.

12. Force majeure

We are not liable for any delay or failure to perform caused by events beyond our reasonable control, including natural disasters, severe weather, epidemics, war, civil unrest, strikes, carrier failures, supplier or print-facility outages, power or internet failures, and acts of government.

13. Governing law and disputes

These terms are governed by the laws of Spain, without regard to conflict-of-law rules, and the courts of Murcia , Spain have jurisdiction.

If you are a consumer, this does not deprive you of the protection of the mandatory rules of the law of your country or state of residence, and you may bring proceedings in your local courts. Consumers in the EU may also use the European Commission's Online Dispute Resolution platform.

14. General

  • Severability: if any provision is found unenforceable, the rest remains in force.
  • Waiver: our failure to enforce any right is not a waiver of it.
  • Entire agreement: these terms and the policies referenced here are the entire agreement between us regarding the Site, and supersede any prior agreements.
  • Assignment: you may not assign these terms; we may assign them as part of a merger, acquisition or sale of assets.
  • Language: these terms are drafted in English; any translation is provided for convenience and the English version prevails.
